1. Platform Description
ServiceWindow is a digital marketplace that connects food truck operators with event organizers, planners, venues, and other service providers in Southwest Florida. ServiceWindow facilitates connections and communications between users but is not a party to any transaction, agreement, or dispute that may arise between users. ServiceWindow does not guarantee bookings, deliveries, services, or outcomes.
2. User Eligibility & Account Responsibilities
You represent and warrant that:
- You are at least 18 years of age
- You have the authority to enter into this agreement and use the platform
- All information you provide during registration is accurate and current
- You will maintain the confidentiality of your account credentials
- You are responsible for all activity under your account
3. Truck Operator Obligations
As a food truck operator using ServiceWindow, you agree to:
- Maintain accurate and current business information, including hours, menu, and pricing
- Hold all required permits and licenses for food service operations
- Comply with all local, state, and federal health and food safety regulations
- Maintain valid food handler certifications for all staff members
- Respond to booking requests in a timely and professional manner
- Honor confirmed bookings or notify organizers immediately of any cancellations
4. Organizer Obligations
As an event organizer or planner using ServiceWindow, you agree to:
- Provide accurate information about your event, including date, time, location, and expected guest count
- Communicate clearly and honestly with food truck operators
- Not submit fraudulent, spam, or malicious booking requests
- Provide reasonable notice (typically 2 weeks) before events
- Honor agreements made with truck operators or provide honest notice of cancellation
5. Booking & Cancellation
ServiceWindow facilitates bookings between users but does not guarantee completion, acceptance, or satisfaction of any booking. Each user is responsible for:
- Negotiating terms, pricing, and menu details directly with the other party
- Confirming all details before the event date
- Following the cancellation policies agreed upon between the parties
ServiceWindow does not mediate disputes between users or handle refunds.
6. Payment & Subscription Terms
ServiceWindow operates on a subscription basis. Payment terms are:
- Monthly subscription plans are billed automatically each month
- Lifetime founding memberships are charged once at purchase
- All billing is processed securely through Stripe
- Refunds are issued within 30 days of request if the service has not been used
- Subscription cancellations are effective at the end of your current billing period
7. Prohibited Conduct
You agree not to:
- Use the platform for spam, harassment, or abusive communication
- Post fake, fraudulent, or misleading listings or information
- Impersonate another user or entity
- Attempt to bypass payment systems or commit fraud
- Share login credentials or allow unauthorized access to your account
- Engage in any illegal activity or violate local, state, or federal laws
- Solicit contact information to circumvent ServiceWindow's platform
Violations of these terms may result in account suspension or permanent ban.
8. Limitation of Liability
ServiceWindow is provided "as is" without warranties of any kind. To the maximum extent permitted by law:
- ServiceWindow is not liable for disputes, disagreements, or breaches between users
- ServiceWindow is not liable for food quality, safety, or compliance issues
- ServiceWindow is not liable for cancelled or unfulfilled bookings
- ServiceWindow is not liable for personal injury, property damage, or other losses arising from user interactions
- Your sole remedy for any issue is termination of your account and refund of unused subscription fees
9. Governing Law & Jurisdiction
These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Collier County, Florida, and you consent to the jurisdiction and venue of those courts.
